1. Acceptance of Terms

By accessing or using Scenetra ("the Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Platform.

2. Eligibility & Age Requirement

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to create an account or use the Platform. The Platform can be used to generate mature and sexually explicit ("NSFW") content, and is therefore intended solely for adults.

By using the Platform, you represent and warrant that you are at least 18 years old, have the legal capacity to enter into these Terms, and that your use of the Platform complies with all laws applicable to you, including the laws of the jurisdiction in which you reside or access the Platform. NSFW content is illegal in some jurisdictions; you are solely responsible for ensuring your use is lawful where you are.

3. Description of Service

Scenetra is a visual AI workspace with a node-based interface for generating images, video, and audio using third-party AI models. The Platform may be used with your own provider API keys ("BYOK") or with platform credits, depending on your plan. AI output is generated by third-party models and is provided on an as-is basis.

4. Account Registration

You must create an account to use the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and promptly notify us of any unauthorized use. You may not share your account, or create an account on behalf of a minor or anyone barred from using the Platform.

5. Adult & Mature (NSFW) Content

Where permitted by law and by the applicable AI model provider, the Platform allows the generation of adult or sexually explicit content. This permission is strictly conditioned on the following, and any violation is grounds for immediate termination:

• You are 18+ and all content you generate depicts only fictional adults or real adults who have given verifiable consent.
• You will never generate, upload, or attempt to generate any sexual or suggestive content depicting minors, or persons who appear to be minors. This is an absolute, zero-tolerance rule (see Section 6).
• You will not create sexual, intimate, nude, or otherwise explicit depictions of real, identifiable people without their explicit consent (including "deepfakes" and non-consensual intimate imagery).
• You will keep adult content private and will not distribute it to minors or in any unlawful manner.

6. Acceptable Use & Prohibited Content

You agree not to use the Platform to create, upload, store, or distribute content that:

• Sexualizes minors in any way (CSAM / CSEM), or depicts any person who is or appears to be under 18 in a sexual or suggestive context. We have zero tolerance for this. Such content will be removed, your account terminated, and we will report it to the National Center for Missing & Exploited Children (NCMEC) and/or relevant law-enforcement authorities, and may preserve and disclose related information as required by law.
• Depicts real, identifiable individuals in sexual, nude, or defamatory contexts without their consent, or is intended to harass, threaten, defame, dox, or impersonate a person.
• Is non-consensual, or depicts sexual violence, bestiality, incest, or other content prohibited by applicable law.
• Violates any applicable law or regulation, or infringes the intellectual property, privacy, or publicity rights of others.
• Promotes terrorism, violent extremism, self-harm, human trafficking, or the sexual exploitation of any person.
• Constitutes fraud, scams, malware, or attempts to disrupt, reverse- engineer, scrape, or circumvent the security, rate limits, or access controls of the Platform.
• Resells or redistributes access to the Platform.

7. Your Content & Responsibility

You are solely responsible for the prompts you submit, the media you upload, and the content you generate ("Your Content"). You represent and warrant that you have all rights necessary to submit Your Content and to generate the resulting output, and that doing so does not violate these Terms or any law or third-party right. You bear all risk and liability associated with Your Content.

8. Content Moderation & Enforcement

We may, but are not obligated to, review, scan (including via automated tools), restrict, remove, or refuse to generate content, and may suspend or terminate accounts, in order to enforce these Terms or comply with the law. We may use automated systems to detect illegal content such as CSAM. We are not liable for any action taken in good faith to enforce these Terms.

9. Third-Party AI Providers

The Platform routes generation requests to third-party AI providers (e.g., Replicate, FAL.AI, OpenAI, Google, AtlasCloud, and others). Your use of those services is subject to each provider's terms, acceptable-use policies, and pricing. Some providers prohibit NSFW or other content even where the Platform might otherwise allow it, and you are responsible for complying with the terms of any provider you use (including via your own API keys).

10. Pricing and Payment

Scenetra may offer a free trial, platform credits, and/or a lifetime license. Where you bring your own API keys, you are responsible for all charges billed by the relevant providers. Prices are subject to change, but changes will not affect existing lifetime license holders. Any refund or money-back guarantee will be described at the point of purchase.

11. Intellectual Property

As between you and us, you retain ownership of Your Content, subject to the terms of the underlying AI model providers and to the rights you grant us to operate the Platform (e.g., to store, process, and display Your Content to you and to provide the service). The Platform itself — including its software, design, and branding — is owned by Scenetra and protected by intellectual property laws.

12. Copyright & DMCA

We respect intellectual property rights. If you believe content on the Platform infringes your copyright, or that content depicts you without consent, contact us at [email protected] with enough detail to identify the content and your claim. We will respond to valid notices and may remove the content and/or terminate repeat infringers.

13. Disclaimers

The Platform and all AI output are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that output will be accurate, lawful in your jurisdiction, non-infringing, or fit for any particular purpose.

14. Limitation of Liability

To the maximum extent permitted by law, Scenetra will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the Platform or from content generated through it. Our total aggregate liability is limited to the greater of the amount you paid us in the 12 months preceding the claim or USD $100.

15. Indemnification

You agree to indemnify and hold harmless Scenetra and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content or your violation of these Terms or any law or third-party right.

16. Termination

We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or if we are required to do so by law. You may stop using the Platform and request deletion of your account at any time. Sections that by their nature should survive termination (e.g., 6, 7, 13–15) will survive.

17. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, and any disputes will be resolved in the state or federal courts located in Delaware, except where applicable law provides otherwise.

18. Changes to Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
